PM Hopes For Swift Action On Karpal...

Prime Minister Datuk Seri Abdullah Ahmad Badawi said Friday he hoped that the Attorney-General would be able to act immediately on the issue of DAP chairman Karpal Singh's questioning of the jurisdiction of the Sultan of Perak in the issue of the transfer of Perak Islamic Religious Affairs Department director Datuk Jamry Sury.

He said that if the Attorney-General felt that there was a case, he should bring the matter to court as soon as possible.

"It is my hope that he will act fast," he told reporters after chairing a special meeting of the Umno Supreme Council at the Putra World Trade Centre (PWTC), in Kuala Lumpur yesterday.

The prime minister said the action has to be immediate because the issue is being followed with great interest by many people.

"Many people are showing interest in the issue. (They want to know) what the penalty is in the matter," he said.

Asked whether the Internal Security Act (ISA) would be used against Karpal Singh, Abdullah said: "If the ISA were used, he would have been detained a long time ago. We have not used it (on him)."

Karpal Singh had said that the Sultan of Perak, Sultan Azlan Shah, had no jurisdiction to reinstate Jamry who was transferred out by Perak Menteri Besar Datuk Seri Mohammad Nizar Jamaluddin.

The sultan had instructed Mohammad Nizar to reinstate Jamry as he had been transferred out without the consent of the sultan as the head of the Islamic religion in the state.

The prime minister had yesterday instructed Umno to lodge a police report against Karpal Singh over his remark which was said to border on treason and had incited anger in the Malays.

The police have so far received nine reports against Karpal Singh, the MP for Bukit Gelugor, over his remark. Among these are one by Umno secretary-general Datuk Seri Tengku Adnan Mansor Thursday and Malaysian Youth Council secretary-general Tajudin Ahmad yesterday. -- Bernama

aha, something fishy about having the pm to urge ag to expedite investigation into YB Karpal Singh.
i though the ag has to wait fir police to complete investigation and wait for police investigation paper then only the ag can decide if there is any case before they can charged anyone? what is the pm trying to do or prove? He thinks he can polically assasinate a learned lawyer? I am sure YB Karpal Singh knows what he is talking about and i am sure he can win over the case if any easily! shame on you pm for using such low hand tactics!!!! As TUN M said- Tak Malu ke?

KUALA LUMPUR: DAP chairman Karpal Singh maintained yesterday that he had not questioned the prerogative of the Sultan of Perak. He said his statements concerning the Sultan's power to revoke the transfer of a state civil servant was purely a legal issue.

Karpal said he was not perturbed over the numerous police reports lodged against him.

"I have committed no offence and those making reports against me should be prepared to face the consequences of lodging false reports," he said at a press conference here yesterday.

"I will not be intimidated by anyone or any quarter.
"I stand by what I have said because the truth must prevail at all times" the Bukit Gelugor Member of Parliament said.

Karpal said he had in no way questioned the prerogative of the Sultan of Perak as head of Islam in the state.

He reiterated that in his view the Sultan had no jurisdiction to direct the state government to reinstate Perak Islamic Religious Department director Datuk Jamry Sury, who was a state government servant.

He said that in Pengarah Pelajaran Wilayah Persekutuan & Others v Loot Ting Yee, the Federal Court decided that a civil servant liable to transfer did not have a right to be heard as a transfer does not amount to dismissal or reduction in rank.

The principles in the decision applied equally to state civil servants, Karpal said.

"I fail to understand why there has been such an uproar on what is purely a legal issue backed by the Privy Council in London, which was until 1985, the highest court in Malaysia."

He threatened legal action against those who made defamatory remarks against him regarding the issue.

In George Town, DAP secretary-general and Penang Chief Minister Lim Guan Eng defended Karpal, saying the party chairman was merely stating a case in law and had done nothing wrong.

He instead accused Barisan Nasional leaders of taking a selective approach and practising double standards.

Deputy Chief Minister I Mohammad Fairus Khairuddin of Parti Keadilan Rakyat said he would leave it to the leadership of the DAP and PKR to address the issue.

He said the Malay members of PKR always respected the palace.

"The issue should not be politicised. It is best for the Perak government and palace to resolve the issue," Mohammad Fairus said.

Did you hear about the poor girl stabbed 4 times! in broad daylight as she walked to work in Cheras? This is the sorry state of affairs in our country right now. Where are all the police? Oh yes, 60 of them busy writing the 9 police reports against Karpal, 7 of them at Raja Petra house, 100 of them at Dataran Merdeka candlelight vigil, half dozen over at Razak Baginda house, 500 driving around looking for pocket money, 80 of them beating up Bandar Mahkota Cheras residents and MP, ... need I go on?

Dear Kak Aina,

I really do not know the difference/gravity between "Karpal's statement on our monarchies" and "the young boy from Johor's (who was eventually arrested) statment in reply to Karpal's remark about Islam". In the case of the young boy, he was merely citing a provision (correct me if I am wrong)stated in the Qu'ran for those you cause emnity and hatred towards Islam.

Lawyers, especially Syarie conversant lawyers, please come forward for an explanation. You may write in Bahasa Malaysia if you wish. I'd consider this issue as wajib to be replied by those who are knowledgeable.

Karpal Singh, MP, LLB, Advocate & Solicitor, was explaining the law. Maybe some people cannot stand him being right on almost everything but that is hardly grounds for alleging his views on the rights of a civil servant amount to sedition. What the Sultan was concerned about was that this civil servant was also a secretary of a committee chaired by him and that his transfer would affect that position. hence his titah ("command"). Whether the sultan's view is correct or incorrect is a matter to be decided in the courst if the civil servant choses to exercise his right for a review.

Remember that the sultan can reign but does not rule. A "saving" in the State laws that it does not affect his rights or privileges was a device used by the British to achieve this end. The legal effect is that such rights were taken away, leaving behind illusory ideas that the sultan was supreme (see articles and books by late Prof Ahmad Ibrahim and other Malaysian academics on the constitution etc. Remember also that the Federal Constitution is the "supreme law" of Malaysia and can and does overide any provisions to the contrary in any state law). However a sultan's judgement can always be questioned if done in a civil and considered manner. That does not amount to biadap in any culture.

Indeed it is a mark of a confident and law abiding society that this can happen. If however, Mr Karpal Singh is alleged to be rude to the sultan, that can hardly amount to sedition. Many BN leaders are regularly guilty of being "kurang ajar" to all and sundry in the high handed manner theya ddress issue. Please grow up and donot bring shame to Malaysia anymore. I am not registered with any of the OpenID bodies so I will just use the name "Anon".

Yes sure!..he wants wift action on this most thretening of statments by Karpal. Yet he twitddled his thumbs and went to sleep when the Lingam video came out.

He just does not know from this alone what is what is not important. He does not know how to prioritise. and yet we let him lead this country.

Yes, while we get gobbled up by vermins and plunderers our leader who ought to be able to respond fast enough will be sleeping on his job. He will need to look at consequences to his position, that of UMNO's and so on before he will respond to any clear and present danger. Feel sorry for myself already.

Be what it may, I will still vote for Pakatan Rakyat during the next elections.

The BN government had in the past committed so many mortal sins against the rakyat that make us look like fools. Pakatan is new and even if this is a mistake, we can overlook a few here and there.

At least our money is still in good hands!

i fully support whatever pak lah wants to do. even if is highly detrimental to the country. after dozing off ever so often, it is a wonder that he can actually comprehend the happenings around him. i have to salute "budak2 tingkat 4" for being able to digest and given excellent advise to this dozing old man. oxford is indeed a wonder-place to send your kids.

only the best goes to oxford and graduate from there. since none (please correct me) of the other MPs are from oxford, these bbt4 must be overworked as they (and only they) are able to give such brilliant advise. sheer brilliance cannot describe my admiration to these individuals.

oops, i was told that pak lah's son-in-law is from oxford too. no wonder i notice something different about him. i wish he had contested in urban areas & try convince the "educted-but-not-from-oxford" voters! it should be "kacang putih" for him. dont you agree with me?

Remember the incident in March 2008where UMNO supporters were protesting in front of the Terengganu Istana in regards to the appointment of the new MB. There was a Banner calling the Istana "Natang". What happen with the police investigation?
