This is, I am sure, the first case of its kind in Malaysia where a Muslim woman gets a syariah court conviction for consuming alcohol.
Thirty-two-year-old model Kartika Sari Dewi Shukarnor wept after the Kuantan Syariah Court yesterday fined her RM5,000 and sentenced her to be whipped six times for the offence committed last year.
She had, earlier pleaded guilty to the charge committed at Cherating Bay Lounge, the Legend Hotel in Cherating, Pahang.
Kartika, from Sungai Siput, Perak, faces a three-year jail term if she fails to pay the fine.
She was charged under Section 136 of the Pahang Administration of the Islam Law and Malay Custom Enactment.
Kartika will be appealing the decision.
Here's another, er...interesting case (I heard this on the radio on my way to work):
A woman stabbed her husband for coming home late after watching the friendly match between Manchester United and the Malaysian team on Saturday night.
The woman, in her 20s, has been remanded for five days.
She had stabbed her 26-year-old husband in the chest. He is being treated at Kuala Lumpur Hospital and is said to be in stable condition.
According to police the woman was so angry with her husband for returning home late. He had promised to be home immediately after the football match on Saturday but, instead, got home in the wee hours next morning (2am, Sunday).
(It was a good game with our Malaysian national team beaten by MU satu gol sahaja. The score was 3-2. And for the record, in the friendly re-match at Bukit Jalil yesterday, MU got over their jetlag and our punishing humidity, storming swiftly with 2-0 win. Still, that's a great Malaysian team we have.)
Drinking alcohol is lethal. The woman was probably drinking a mixture of fruit juice, water, malt, yeast,fermented grains and others.

Tapai, is almost similar. Tapioca or Pulut is fermented with yeast and no alcohol is added, but it is not considered as consuming alcohol and enjoyed by millions of holier than thou Muslims, without paying a fine, going to jail or whipped.
Is this one of the unfounded wonders of the world?

wonders why people aren't whipped for eating tapai which actually reeks of alchohol. (smells just like vodka!) i did actually challenge a friend who was worrying about whether spraying perfume on her skin was okay or not, and she told me that tapai didn't count!

ReplyDeleteWhat is even more surprising is the only person brought to court for Sodomy is Datuk Seri Anwar Ibrahim (Not once but TWICE). As far as I know no one else has been prosecuted for that offence.

It certainly seems strange that all female students in schools are spared from corporal punishment as a matter of policy but some may not escape the whip as adults from only the religious courts.

Alahai garang dan brutal betul the wife! Tapi takkan sampai buat cam tu to the hubby. Don't think the wife mad at MU but because the hubby did not kept his words. Unless she's a Liverpool's fan?? Teruk la dunia cam!
Btw, I believe canning is provided under the said Enactment, so the judge acted within his jurisdiction. Islam abhors drinking alcohol and it is for a good reason.

ReplyDeletePersonally, I found out that the punishment is not accordingly to Islamic Laws (what I read and discuss with my friends) and Federal Constitution. For Anonymous @ 11.58 am, eating Tapai ubi or Tapai pulut is not similar with drinking alcoholic drinks and this is based on fatwa ulama from Kelantan on Pattani. This can be discuss further in appropriate manner and forum.....
Wonder why no hukuman for those who take drugs-which obviously are more dangerous leading to social ills.

This is ridiculous! Whipping a woman for consuming alcohol, what can be more ridiculous?If consuming alcohol defiles the body, smoking also defiles the body.How come the smokers are not whipped?Actually the smokers cause more harm than the alcohol consumers to themselves and to the general public!

Alcohol in its true form is not fit for human consumption. A bottle of beer can be consumed by any normal person and cause no effects whatsoever. But try drinking a bottle of methylated spirit.
Therefore, how do we draw a line between sane and insanity when it comes to the subject of a social drink?

ReplyDeleteI too read the news - I was a bit disturb but only a little. I am not sure why I was disturb but maybe because there are so many more out there doing it and yet this lady gets sentenced to the whip. I thought the fine was OK -but the whip ....I visited Pudu jail in 1999 and was given a tour of the place and there I also found out how whipping takes place. It makes you dizzy just thinking of the procedure.
I am a Muslim and my knowledge on Islam is only good for myself - meaning I cannot put forth fatwa and engage in debate. We cannot halalkan yang haram and vice versa, but I think if the Government is going to exercise such punishment they must be a bit more transparent.
I hope they review the charge and remove the whipping.

On a personal note, I grew up with NST, had been a regular paying reader since my primary school until 1998. My late father a civil servant was an NST subscriber since 1960's till he returned to his MAKER in 2000. Now I read NST only if it is available in the office.
Hopefully, You can bring CHANGE to NSTP. If someone likes En. Mike writes a rebuttal to Zainul's piece, Can you put that up in your NST.
That is the least you can do for a free press..
And please leave/avoid words like Bodoh...It is not politically correct...

We as commenter and bloggers often get told over and over again that we should and that we cannot write everything that might come to mind. There is the thing called responsibility and there is the thing called libel! These two restraints are the ones that guide me along in my writing and stop me from saying a lot of stuff especially when I am angry. Of course there are other personal attributes, for which I got to thank my upbringing maybe, that keeps me from being impolite or being a nuisance.
But what Zainul Ariffin wrote was incitement and mischievous. Not befitting for publication and certainly very embarrassing for the chief Editor of the NSTP. group.
But for you to defend his right to PUBLISH his opinions I would tell you that you are wrong. This write up was not defendable and you, a seasoned newspaper person should have known better!

But the general public can only judge people from what is apparent in their writings.
I am all for free speech. But how does one interpret Zaibur Arifin's words asking the Selangor MB as to why he is questioning his own people, the Malays.
I mean, when was it right in our country for people to refrain from legitimate criticism based on mere racial considerations.
It is a fact that 80%-90% of the members of MACC and PDRM (and their oversight Boards)are Malays. Thus the chances are that if anyone casts a stone it will hit a Malay. It is so too for the Civil Servants and most Government Bodies and Institutions, including the Judiciary.
Does that mean no one should question them for negligence or suspicious behaviour - the Chinese and Indians because that would be considered racist, and the Malays themselves because that would be traitorous to their own people?
Surely that is nonsensical?
And I don't buy Nazri's stupid statement that these are Malay Institutions. It is up to the Govt of the day to ensure that the staff mix in all Govt controlled Institutions and bodies is equitable and representative of merit.
If it is not so, it's about time someone took up the cudgel to rectify the matter. And that's where the Opposition is winning hands down which has UMNO/BN politicians and controlled MSM editors play up the race card as a last line of defence!

Should alcoholic drinks be sold in petrol kiosk, 7-11, provision shop or restaurants? What about hospitals? If hospitals have no such sales I do agreed that the above mentioned locations should be banned as well. The reason being "Act Like Romans when you are in Rome" or should I say "This Land is righfully ours as such we have the rights to our land". Sale of alcohol can only be applied at hotels, entertainment outlets such as genting highlands or pubs and discos since we encourage tourist to our land. It will not be an issue for all religion to consume alcohol in hotels since this is privately owned and as such the Syariah raids are invalid. Hotels is a destination for all race and religion. Pubs and discos or casinos is an entertainment outlet that encourages immoral values and as such the Syariah raids are considered valid... Poor girl to be whip since the laws are so badly implemented!!!
