Razak Baginda Acquitted.

The judge ruled that the prosecution failed to prove a prima facie case against Abdul Razak Baginda. He was acquitted at the Shah Alam court this morning.

Abdul Razak was on a murder abetment charge in the murder case of Mongolian Altantuya Shaariibuu.

C/Insp Azilah Hadri and Kpl Sirul Azhar Umar, members of the Special Action Squad (UTK), were ordered by to enter their defence against the murder charge.

Both of them chose to testify under oath.

Azilah and Sirul Azhar were charged with murdering Altantuya at Mukim Bukit Raja, Selangor, between 10pm on Oct 19, 2006 and 1am the following day.

Abdul Razak was charged with abetting them in the murder of the beautiful 28-year-old translator.

    since Razak is free now from the charges only two still remain - the 2 policemen.

    but my main concern is who did gave the order to did such thing towards Atlantuya?was it really Najib or Rosmah who gave the order?or was it someone else entirely?

    in the other hand,Razak is a free man now because really he's innocent or the prosecutor are too weak to prosecute him?

Abdul Razak Baginda himself knows whether he is guilty or not.The fact that his defence is not called is due more to the imcompetence of the prosecutors than anything else!He does not have to proove that he is innocent, unlike the two other persons accused of the cold-blooded murder.I believe justice will eventually prevail!

  10. We all know that this verdict will not go down well with certain quarters.

    This is outrageous! The assumption that all judges and judiciary officers in this country are in UMNO's pocket is absurd. Remember that the same system delivered the no-guilty verdict on Anwar, but I didn't hear any whimpering from the UMNO quarter that judges were on Pakatan Rakyat's payroll.

    There have been numerous verdicts that stood against the interests of the ruling party in the past, a testimony that judges in this country actually HAVE A MIND of their own.

    Razak Baginda has been acquitted because there is no prima facie case against him based on the trial facts. It is immature to expect a judge to issue a verdict based on you think, know or believe. ONLY FACTS COUNT.

    Come on people, grow up. leave the judiciary body in peace.

    If altantunya had been a US or a British citizen it would have been a different story wouldn't it? She's Mongolian and that shows how we always mistreat people who we perceive coming from a country more inferior than us.

  16. If Baginda has no case to answer, then what would the motive be for the other two to carry out the alleged killing when they would have been total strangers to Altantuya/

    Hi Nuraina,
    The fault is with the prosecution. If I were the judge and based on the facts presented,I too would acquit Razak. It was very abvious that the prosecution predesigned it bungle. The evidence presented was crapy and "solid" evidence was biasly ommitted from being presented. The judge can only make his decision based on evidence presented to him. The real question is why the prosecution did a very poor job bordering blantant neglect to duty and country. Sigh. Anyway, there is still the HIGHER court that awaits ALL of us.

    Now everyone here in Malaysia always wants ANYTHING to be on their sides. This case included. If the verdict came out as what we want, we are happy, but if the verdict came out on the opposite, we will not happy and of course we quickly say the judiciary is not independent.

    I think its time we abolish the court of law and everyone here becomes judge. We can have our own court. May be it is better for ALL of us...!

    I was told once by a lawyer that the law deals with the facts of the case, not emotions. A lawyer is not to prejudge if a person he/she is defending is guilty or not, even if he/she has an opinion. The lawyer is to present the best defence possible and let the judge rule.
    In this instance, we ought not to let our emotions and bias make us prejudge RB's guilt or otherwise. The case before the judge is murder, not corruption. Do we really believe that RB have given the order for Altantuya to be killed and the people who carried it out had listened to him? Or that he is aware of the intent to murder and have abetted by ensuring that Altantuya is at a certain place at a certain time so that the deed can be carried out? Or maybe we want him to enter his defence so that he can spill the beans, so to say?

    There is no contempt of court once it has given a judgement. You can comment on the judgement...all law students (at least in civilised countries)do that as part of their readings of the law.

    Each judgement is also a reflection on mores of a society and the quality of its VALUES, not just the mental ability of the judge. History will judge the outcome in due course. If Justice was done, the judge will have a clear conscience and history will judge him/her accordingly in each case. If not, then it will be a clear case of contempt of rule of law and something very dear to us all, of Justice itself.

    So please comment....freely and without fear. You can exercise restraint and say "I believe the judgement is novel" (which means that it is rubbish but then our less intellectual fellow citizens will not bother you as a kaffir or as a traitor that way).

  29. reading the self-serving or exculpatory statements made by razak in his affidavit i don't see where and how did those statements help razak to get his acquittal. he was just denying his involvement but the fact remains that despite knowing what azila could do i.e. have killed many people yet he proceeded to ask azila to help him?! why did the judge rule out that statement? prejudicial? that was what razak said in his sworn affidavit. well well hard to understand :-)
