Kuala Lumpur: The question of who is the rightful menteri besar of Perak will be decided Monday.
High Court (Appellate and Special Powers Division) judge Datuk Abdul Aziz Abd Rahim today fixed Monday, at 2.30pm, to deliver his decision in the judicial review application filed by ousted menteri besar Datuk Seri Mohammed Nizar Jamaluddin who is seeking the court's determination of the dispute.
On Feb 13, Nizar, 52, filed an application to the court for a declaration that he is at all material times the menteri besar of Perak.
Nizar, who was appointed as menteri besar on March 17 last year after the Parti Pakatan Rakyat-led alliance won 31 seats in the 12th general election, also sought a declaration that Datuk Seri Dr Zambry Abdul Kadir has no right to hold the office of menteri besar.
The High Court, on April 3, granted Nizar leave to initiate the proceeding against Zambry.
Justice Abdul Aziz was the third High Court judge to hear the case, after Judicial Commissioner Mohamad Ariff Md Yusof, who had recused himself, and Justice Lau Bee Lan.
The case was referred twice to the Federal Court for its determination on the constitutional issues, but was remitted back to the High Court on last April 28.

A) If the decision is in favor of Nizar
Anwar "This is the aspiration of the Rakyat'
Lim Kit Siang "At last the truth prevails for the Perakian"
B) If the decision is not in favor of Nizar
Anwar "The abuse of power, corrupted judiciary, no separation of executive ". "Let the Rakyat decide, call for dissolution"
Lim Kit Siang "The IQ of the judges is very low, the sandalous judiciary, disgrace of Najib of its One Malaysia"
BN/UMNO has committed yet another serious mistake!Both BN and Pakatan have resorted to the Judiciary, and
before a conclusion is reached as to who actually is the rightful MB, we, the people, have to see the spectacle
of BN/UMNO carrying out its final brutish coup,using the police and civil servants to do their will!
Does BN/UMNO really care for the feelings of the raayat?.Does BN/UMNO really respect the Constitution --supreme law of the country?Does BN/UMNO really believe in Democracy?Does BN UMNO really respect the Judiciary?Does BN/UMNO really respect the Monarchy that they, time and again,try to impress upon us?It seems to me that all the PM's attempt to win over the people through his 1Malaysia slogan is going down the drain!Cakap tak serupa Bikin.Its just a Public Relation Blitz and it will have absolutely no effect on the raayat....unless a snap election is held to allow the Perakians to decide who they want to form the Government!

Nobody gives a damm about our judiciary nowadays!Money and power can buy anything!Most will know how the verdict goes on Monday.A fool will only back Nizar if its a malaysian judiciary.Tell you poor Nizar was made to climb a slippery wall glazed with oil with his bare hands come monday!
the court should rule in favor of Nizar. Why? because he was not removed from being the Mentri Besar in the MAY 7 sitting and the Sultan of Perak can't remove him from being the Mentri Besar. Even our former PM TDM said so.
In conclusion, if the High Court rules in favor of BN, then it is obvious the Judicial of Malaysia is so CORRUPT that it was right in th first place to support PR.

Oh... I do give a damn about our judiciary.
It is a foregone conclusion. That is as much faith I have of our courts.
Reid Commission Report para 69 clearly says the Prime Minister (in relation to the Federal) should tender the resignation of his cabinet if the Agong (Yang diPertuan Besar as referred to then) does not accede to the request for dissolution of the Parliament. The Federal Constitution adopted this recomendation as well as the States. This simply means that Nizar defied the Constitution when he "sembah derhaka".
It is just plain human that if one does not get what he wants from the court he will criticize the latter to the fullest and drag the govt etc for interfering and exercise influence over the judiciary and claiming it corrupt. but look when anwar was acquitted, the federal court when it remitted nizar v zambry back to the high court, and many more in favour of the opposition, they said that was justice. The judiciary is good ONLY when it decides in favour of the opposition? That seems to be the norm now..sigh..
Rakyat dah tahu dah keputusan Hakim itu. Dah tertentu akan menyebelahai BN/UMNO. Kita dah tahu tatakelakuan hakim-hakim sekarang. Tak boleh diharapkan.
No need to wait till monday. I already know which way the decision is going to be. After all what can we expect from UMNO fearing judges. The case is so clear cut that ONLY THE ASSEMBLY HAS THE POWER TO REMOVE AN MB. But they will choose judge like augustine paul to bastardise the judiciary. I'm very happy if I'm proven wrong. Of course there are also other judges very unlike the wicked paul. Of course we will salute and praise the judge who upholds the law irrespective of whether it favours the govt or the opposition. but such judiciary is long gone (since 1988). For those who still give a damn to our damned judiciary, no amount of rational arguments can change them and we shudn't waste time to do that. Biarkan loncai dengan labunya...

what is binding now is the constitution not the reid report. go and read the wording of the constitution properly. the pm can ask agong to dissolve parliament even if he does not lose confidence of parliament. e.g when pm wants early ge before 5 years is up. if agong refuses the pm needs not resign. similarly nizar needs not resign unless he loses confidence of the assembly. how to determine it? assembly must be convened and the motion tabled and passed. this was not done. people can argue that loss of confidence can be determined outside the assembly as had been done in this case. well i can only give this analogy. supposing tengku razaleigh (being the wealthy man that he is) managed to gather enough umno delegates in his home to declare loss of confidence in najib as umno president. will najib recognise that meeting? very likely najib will say: if anybody loses confidence in me he must have enough number of delegates to requisition for an egm to be properly convened by the sec gen where the necessary motion shud be tabled and passed. then i will resign as president. i agree with najib on that stand.

Karpal Singh once lambasted Malaysia's Chief Justice by calling the head of the Judiciary "KEMALUAN BESAR PADA NEGARA".
And soon the High Court of Malaya will deliver a judgment on who will be Perak's rightful MB.
My bet is on Zambry of course. Not because I support UMNO, but because I feel that BN has got a truly solid case. The Pakatan Rakyat simply DO NOT HAVE enough seats in the State Assembly to form a government. It is a matter of simple maths and you don't need a calculator to apprehend this.
This is a clear cut case, and it is my opinion that even a junior Magistrate could see this on his bench.
However, if the court would rule in PR's favor, then it is my duty as a law abiding citizen to swallow the judgment without any prejudice.
No need to accuse the presiding Judge as a "kemaluan besar pada Perak".
